Client/Class Participant hereby acknowledges and agrees that Instructor is not an employee of First Fitness, LLC, nor First Fitness - West Point. Further, Client/Class Participant acknowledges and agrees that First Fitness, LLC, and First Fitness - West Point are not responsible for any actions of Instructor or the Instructor-Client/Class Participant relationship. Client/Class Participant hereby agrees to indemnify and hold harmless First Fitness, LLC, and First Fitness - West Point from any and all risks, claims losses, damages, injuries, costs, and other liabilities associated with, related to, or sustained in connection to Instructor’s services and actions and the Instructor-Client/Class Participant relationship.

I understand the risk of injury from physical exercise club (hereinafter referred to as "Club") activities and using any Club equipment is significant, including the potential for permanent paralysis and death. I KNOWINGLY, INTELLIGENTLY, AND VOLUNTARILY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an UNSUPERVISED FITNESS CENTER/CLUB and I assume all risks associated with using exercise equipment and other products and machines and exercising alone without the aid and presence of Club staff on premises. In addition, I acknowledge that Club activities may include outdoor activities which may present additional risks, such as slippery surfaces, uneven surfaces, loose rock or gravel, and unseen roots and other items. I understand that First Fitness, LLC is doing business as First Fitness - West Point. I HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS First Fitness, LLC, First Fitness - West Point, its affiliates, sponsors, advertisers, owners, members, agents, officers, and employees, and all owners and lessors of the premises on which the Club is located and operated WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, LOSS, OR DAMAGE to any person or property that may arise out of or in connection with my presence on premises on which the Club is located and operated, use of any of the equipment products and machines or the facilities of the Club, or any indoor or outdoor exercise program offered at or by the Club, or of any other First Fitness, LLC Club, or any incident that occurs while using such facilities, or otherwise related to my membership. I expressly agree that this Release is intended to be as broad and inclusive as permitted by applicable law and if a portion of this Release is held invalid by a Court of competent jurisdiction, the balance shall remain in full force and effect. This Release shall apply to my heirs, beneficiaries, assigns, agents, family members, invitees, guests, personal representatives, and any other next of kin. I understand that the Club is relying on this Release in agreeing to enter into this Agreement.

I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTIONS OF RISK AGREEMENT, FULLY UNDERSTANDING ITS TERMS AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
